Milan P. Spisek is a seasoned healthcare and litigation attorney with 35 years of experience representing hospitals, nursing homes, and healthcare professionals in the New York metropolitan area in complex medical malpractice cases. In addition to his practice defending the medical community, Milan is frequently consulted to give opinions as to the procedural and substantive viability of appeals from adverse orders and judgments to clients and colleagues.
Milan defends healthcare professionals in high-exposure cases in all practice areas of medicine, including obstetrics, neurosurgery, surgery, plastic surgery, orthopedics, cardiology, oncology and infectious diseases, and Milan defends nursing homes in claims arising from falls, pressure ulcers, medication errors and other issues. His practice includes state and federal court, on both the trial and appellate levels. In his federal practice, Milan deals with cases that represent a hybrid of medical malpractice allegations such as claims pursuant to 42 U.S.C. § 1983 for failure to provide medical care, and claims under the Americans with Disabilities Act and various other federal and state civil rights statutes. Milan has extensive successful appellate experience with an impressive number of reported decisions, as well as successful arguments in the Second Circuit Court of Appeals.
Before coming to VLMMR, Milan worked for a large prominent medical malpractice defense firm in the New York Metropolitan area. He has received an AV® Preeminent™ rating by Martindale-Hubbell, which is their highest rating. He is licensed to practice in New York and Connecticut. Milan is additionally admitted to the U.S. Court of Appeals, Second Circuit, U.S. District Court of New York, Southern District and Eastern District, U.S. District Court of Connecticut and the New York Appellate Division, Second Department, Supreme Court of New York.
Outside of the office Milan has many interests, and he has been active in many civic and community activities. He was a member of the Planning and Zoning Board for the Town of Easton, where he formerly served as a scoutmaster for his town’s Boy Scout troop. He has represented the Bronx Bar Association in a federal civil rights claim on a pro bono basis. Milan has served his community as an AYSO soccer coach, recreation league basketball coach for both girls’ and boys’ teams and has performed volunteer work for a local food pantry. He has worked with the local volunteer fire department in representing them before the town’s Board of Selectmen with regard to funding issues. Over the years, Milan has also been active in the Czech and Slovak immigrant communities of New York as a director of a youth group.
